Notes to remember...
Group Leader, Authority and
Payments.
The person completing the booking form will be the group leader
for the duration and he/she will be our point of contact.
In submitting the booking form to us you will be accepting
that the group leader has the authority to deal with us on
behalf of every member of the group. We will not normally
enter into discussions with any other member of the group.
If for any reason there is a change in group leader, you should
notify us in writing immediately, and we will not accept any
change unless that condition is fulfiled. The group leader
is responsible for collecting all monies from his/her group
and for making all payments due and for ensuring that all
members of your group adhere to the terms and conditions.
For overnight stays, the group leader or nominated person
within the group must sign an Accidental Damage and Deposit
Form prior to checking in, a section of which comprises a
valid credit card authority to be held by the hotel management
for the duration of the stay. Management may refuse entry
without that signed authority document.Deposit payments for
Activity or Event only is 50% per person plus relevant insurance
premium. Deposit payments for Activity or Events with overnight
stay is £30 per person plus relevant insurance premium.
We do not send reminders for when balances are due and it
is your responsibility to pay the balance before the due by
date. If full payment is not received on time, we have the
right to treat the booking as cancelled
by you. In this event, you will be liable for the cancellation
charges as set out in the Terms & conditions.
Event Packs
Please read this pack carefully and notify us immediately
if you have any queries. We cannot accept liability for your
arrangements if we have not been notified within 7 days of
sending the Event Pack to you.
Contract
Subject to the terms relating to reservations your contract
is with Red Seven Leisure Ltd and comes into existence when
we accept your deposit payment and issue a booking confirmation
whether
orally or written. It is understood that those booking via
telephone or e-mail accept our booking terms and conditions
without having signed the booking form.
Changes to Your Booking
We reserve the right to amend or substitute alternative arrangements
of any element in a booking subject to operational or reasons
beyond our control to an equal or greater standard or value.
If you wish to make any alterations to your booking after
it has been confirmed, a £15 administration charge per
person will be levied for groups of 6 persons or more. All
changes must be made direct with Red Seven Leisure. Amendments
cannot be made within 7 days of the event or commencement
of booking. Should your group size reduce after placing your
booking, please refer to cancellation charges as set out in
the Terms and Conditions. We will, subject to availability,
endeavour to
allocate you additional places within a booking should you
require them and in this case only, our administration charge
should not apply.
Special Requests.
If you have any special requests, please inform us at time
of booking in writing. We will be pleased to assist wherever
we can.
Meals
Certain events in this brochure contain meals. Example menus
may be represented in this brochure for guidance only and
give a good indication of type of meal included. We cannot
arrange alternative meals for special diets without knowing.
Should any member of your group have any special dietary requirements
at all, INCLUDING VEGETARIAN, you should notify us in writing
at least 14 days prior to your event. English or Continental
Breakfast is included in all overnight stays.
Itineraries
We are unable to arrange individual itineraries. Bookings
are made and accepted on the basis that everyone has the opportunity
to participate in the same booked group itinerary. I.e. If
the group books paintball, alternative activities cannot be
made available for individuals within the group, unless the
group has also booked additional or alternative activities.
INSURANCE
When booking a Holiday it is always advisable to insure yourself
against cancellation or unforeseen
circumstances. Our breaks are no exception - especially when
there is a dangerous sport or activity involved. Because of
the risks of participating in activities, we offer Holiday
Insurance with added
benefits to cover not only your holiday booking, but also
your participation in activities in this brochure. Some activity
suppliers will require you to sign an insurance indemnity
waiver prior to participating in an activity. Therefore, for
your security and peace of mind, we insist personal insurance
is required for all our breaks, activity based or otherwise.We
will not accept any booking from you unless you have
adequate insurance cover to participate in the chosen break.
You can request cover through us, or you must provide us with
evidence that you have effected cover of insurance elsewhere
for every member in your group and will be covered for the
risks normally covered in the policy of insurance we offer.
We arrange insurance on your behalf with British Activity
Insurance Services, underwritten by a consortium of insurers.
Payment of the premiums must be made when you book your event
and cover will be
effected from the time we confirm acceptance of your booking
in writing. Please note that once cover is effected, you must
read the policy certificate carefully. The policy certificate
contains a "cooling off" period which allows you
to return it and obtain a full refund if you have justifiable
reason to be
dissatisfied with the cover provided. After this seven day
"cooling off" period, there can be absolutely no
refund of premiums.
Cover is effected subject to the terms and conditions of the
master policy.

Section 1 BOOKING AND PAYMENT
1.1. in every case
A. read the terms and
conditions
B. complete the booking
form inside this brochure by inserting all the necessary details
required. Remember that we cannot know information that you
do not give to us, and so it is essential that, for example
if you have any special requirements (e.g. where food is to
be provided and some of your party are vegetarian, or a member
of your party has a specific medical condition) you should
inform us of those requirements at the time of submitting
the booking form to us. You must tell us if any member of
your party is under 18 years of age.
C. make payment. Write
out a cheque made payable to Red Seven Leisure Ltd or complete
the credit card authority for the deposit required (£30
per person) and the insurance premiums if the booking is made
more than 42 days prior to the event date shown on the booking
form ("event date"), or of the full cost if the
booking is made within 42 days of the event date. If you are
paying by credit card add 2% (representing our charge) to
the total cost of each transaction.
D. send the form and
the cheque/payment authority to us.
1.2. for bookings by
telephone or fax
A. we rely on the information
you give us in making a reservation request and will endeavour
to hold that reservation for three days. You must send to
us immediately the original completed signed booking form.
If we do not receive this within three days of the booking
we reserve the right to cancel the reservation.
1.3. payment
A. we may cancel the
reservation if a promised cheque is not received or does not
clear upon presentation. In the event of non clearance or
representation of a cheque you will pay a charge of £20.
1.4. for all bookings
A. we will endeavour
to hold a reservation for a maximum of five working days from
the date of booking. When payment is received we will endeavour
to confirm our acceptance of the reservation with you. However
we reserve the right to cancel the reservation in the event
that we cannot confirm the reservation with the supplier in
which event we shall return to you all monies paid within
seven days.
1.5.1 the terms of
section one shall apply even if a reservation is cancelled
by us before the
reservation is formally confirmed by us in writing.
1.5.2. acceptance of
the booking is effective when we write to you formally with
a booking
confirmation and the following terms and conditions will then
apply.
Section 2 TERMS AND CONDITIONS
A. payment of the balance
of total costs due must be made not less than 42 days prior
to the event date. Payment of any other charges arising must
be made not less than 10 days before the event date, unless
we agree otherwise in writing. If such payment is not made
as stipulated you will be in breach of your contract with
us and, without prejudice to any rights arising there from,
we may cancel the reservation and retain the deposit sum.
It is therefore essential that you make payment on time. Full
information of the reservation details will only be provided
on full payment. Each payment by credit card will be subject
to a 2% surcharge.
B. booking amendments
B1. additional facilities:
booking conditions in Section 1. will apply to any requested
B2. reductions: no
refunds will be given either for reduction in numbers of a
party, reduction in numbers using specific facilities at the
event
B3. we may charge an administration fee of £15 for each
amendment
C. price amendments
C1. VAT at 17.5% is
included in the brochure price. Any increase in the rate of
VAT prior to the event date will be charged to you. Companies
will have VAT added to the brochure prices at the prevailing
rate
C2. the prices shown
in the brochure are correct at the time of going to press,
but if our facility costs should increase significantly after
acceptance of your booking resulting in increased charges
we will notify you in writing of the increase as soon as possible
and not later than
28 days before the event date. You may cancel in writing the
reservation in whole or in part within seven days of such
notification and we will refund the cost attributable to that
part of
the reservation cancelled. In the absence of such cancellation
you will be deemed to have accepted
the increased charges. Any additional sums under this provision
must be paid in accordance with
section A
D. cancellation
D1. you may cancel
the whole of the reservation, but not part, at any time provided
you do so in writing. If you do so earlier than 42 days before
the event date you will forfeit your deposit paid to us. If
you cancel 42 days or less before the event date we will refund
to you the total cost of the reservation less any insurance
premium and less our cancellation charges as set out in D2.
No refund will be given for insurance premiums
D2. No. of days cancellation

of the balance of total costs more than 14 days but less than
26 days: the deposit and 90% of the balance of total costs
less than 15 days: 100% of the balance of total costs
D3. we may cancel all
or any part of the reservation if
D3.1. full payment
is not received in accordance with these terms and conditions,
and no refund shall be due or
D3.2. we cannot make
alternative arrangements under clause E.1., and we will make
full refund to you in respect of the part cancelled
D3.3. any members of
your group behaves in an unreasonable way which in the opinion
of our
supplier is likely to cause distress damage danger or annoyance
to any other customers of the
supplier, it's employees or property or any third party, and
no refund will be due
D3.4. in the opinion
of our supplier any member of your group is unfit to take
part in any aspect of the reservation, and no refund will
be due
E. changes
E.1. if we cannot provide
all or any part of the reservation due to circumstances beyond
our
control we will endeavour to make alternative arrangements
and notify you of any changes as soon as possible. We will
refund to you the cost of that part of the reservation if
we are unable to make arrangements reasonably acceptable to
you, except any activities under
E.2. if we cannot provide
any air sport activity (e.g. ballooning, gliding etc.) due
to weather
conditions we will provide you with a credit voucher exchangeable
within six months, but we will not give you a refund. If we
cannot provide an agreed and arranged facility of nightclub
entry due to reasons beyond our control (e.g. unforeseen or
unadvised closure of licensed premises or cease of trading
on the premises) we will provide you with a credit voucher
exchangeable within six months, but we will not give you a
refund.
F. general
F.1. you must adhere
to any on site conditions of use and instructions given -
a breach may result in cancellation of all or part of the
reservation. In the case of overnight stays you must deposit
with the hotel management a valid credit card authority to
cover extra costs or breakages attributable to the group,
and you may be refused entry to the accommodation if you do
not provide the authority.
F.2. monies paid to
us are held in a separate account until after your booked
event, in keeping with the Package Holidays and Tour Regulations
1992
F.3. in preparing details
of any facilities in this brochure we have relied upon information
given to us by our suppliers. All photographic and pictorial
references are purely representative of the facilities and
products within this brochure and will be accepted as such.
Whilst we believe any representations to be true we cannot
accept liability for any false representation or breach of
implied warranties of any kind as to the facilities on offer
and we shall not accept liability for any loss arising from
any cause save to the extent that we have been in breach of
these terms and conditions. In any event our liability will
be limited to the amount of the total cost of the reservation
less any insurance premiums.
F.4. no refund will
be paid if the reservation cannot be provided because of force
majeure events
F.5. payments will
only be accepted from and refunds given to the Group Leader
for the time being
F.6. notices in writing
from you must be signed by the Group Leader for the time being
F.7. this is the sole
agreement between you and us and may not be varied save by
agreement of both of us (whether orally or otherwise) and
confirmed in writing by foxy chicks and signed by an authorised
officer of foxy chicks.
F.8. this agreement
is governed by English Law and shall be subject to the jurisdiction
of the English Courts.
